1. Introduction
AIvalynx (hereinafter referred to as "Company," "we," "us," or "our") is committed to providing transparent and fair subscription management practices. This Cancellation & Refund Policy outlines the terms and conditions for cancelling subscriptions and processing refunds for our AI-powered educational assessment platform.
2. Subscription Terms & Billing
2.1 Subscription Plans
- AIvalynx offers flexible subscription plans on a monthly, quarterly, and annual basis for educational institutions.
- All subscription pricing is displayed in Indian Rupees (INR) unless otherwise specified.
- Pricing is subject to change with 30 days' prior written notice for existing subscribers.
2.2 Automatic Renewal
- Subscriptions automatically renew at the end of each billing period unless cancelled.
- The subscriber will be billed on the same date each month/quarter/year as indicated in their account dashboard.
3. Subscription Cancellation
3.1 How to Cancel
Subscribers may cancel their subscription at any time through the following methods:
- Through the Account Settings section in the AIvalynx dashboard
- By sending a written cancellation request to info@aivalynx.com
- By contacting our support team with the institution's subscription details
3.2 Cancellation Effective Date
- Cancellations requested before the end of the current billing period will take effect at the end of that period.
- No charges will be made for future billing periods after cancellation is confirmed.
- Access to the platform will continue until the end of the current billing period.
3.3 Data Access After Cancellation
- Institutions may export assessment data and student records for up to 30 days following subscription cancellation at no additional charge.
- After 30 days, data will be retained according to our Data Retention Policy as specified in the Privacy Policy.
- Institutions requiring extended data access may contact support to arrange alternative arrangements.
4. Refund Policy
4.1 General Refund Terms
AIvalynx is a service-based subscription platform. Refunds are generally not provided for subscription fees already paid, except under the following circumstances:
4.2 Conditions for Refunds
1. Early Cancellation (Trial or Initial Period)
If an institution cancels within the first 7 days of a new subscription, a full refund of the initial payment will be provided, provided that the platform has been used for less than 20 minutes in total.
2. Duplicate or Erroneous Charges
If the institution has been charged twice for the same subscription period due to system error or processing fault, the duplicate amount will be refunded in full.
3. Service Unavailability
If AIvalynx experiences unplanned downtime or service unavailability exceeding 24 consecutive hours that prevents normal platform usage, the subscriber may request a pro-rata refund for the affected period.
4. Payment Method or Authorization Issues
If a charge was processed without proper authorization or due to unauthorized use of payment credentials, the subscriber may file a dispute, and we will investigate and process a refund if liability is established.
4.3 Non-Refundable Scenarios
Refunds will NOT be issued in the following circumstances:
- Cancellation requested after the 7-day trial period (standard policy applies).
- For non-usage or change of mind after the trial period has expired.
- For pro-rata refunds on partial usage of a subscription period (except in cases of service unavailability).
- If the subscription was used with full access to all platform features.
- For customization, implementation, or consulting services rendered.
4.4 Refund Processing
- Approved refunds will be processed within 7-10 business days.
- Refunds will be issued to the original payment method used during the subscription purchase.
- For credit card payments, the refund will appear as a credit on the monthly statement.
- For bank transfers or other payment methods, refunds will be processed via the reverse transaction method.
- Banking delays may result in extended processing times (up to 15 days from AIvalynx's processing date).
5. Refund Requests
5.1 How to Request a Refund
To request a refund, subscribers must submit a written request to info@aivalynx.com with the following information:
- Institution name and subscription account ID
- Billing period for which refund is requested
- Clear reason for the refund request
- Supporting documentation (screenshots, error logs, payment receipts, etc.)
5.2 Refund Review Process
- All refund requests will be reviewed by our Accounts team within 5 business days.
- Subscribers will be notified of approval or denial status via email.
- If a refund is denied, the subscriber will receive a detailed explanation of the reason.
6. Plan Downgrades and Changes
- Subscribers may downgrade to a lower-tier plan at any time by submitting a request through the account dashboard or contacting support.
- Downgrades take effect at the start of the next billing period.
- Pro-rata refunds for mid-period downgrades are not provided; however, credits may be applied toward the next billing cycle in certain circumstances.
7. Mid-Term Subscription Termination
7.1 Annual Plan Termination
For subscribers on annual plans who request termination before the end of the contract period:
- A penalty equivalent to 10% of the remaining subscription value may be applied.
- The remaining balance (after penalty) may be refunded if requested within 30 days of termination.
- Access to the platform will continue until the end of the current month or upon mutual agreement.
8. Dispute Resolution
- Subscribers dissatisfied with a refund decision may escalate their case by submitting a detailed appeal to info@aivalynx.com within 15 days of the initial decision.
- The appeal will be reviewed by a senior member of the management team and resolved within 10 business days.
- All disputes will be governed by the laws of India, and the parties agree to submit to the exclusive jurisdiction of courts in the state of the subscriber's headquarters or as per their Terms and Conditions.
9. Changes to This Policy
- AIvalynx reserves the right to update or modify this Cancellation & Refund Policy at any time.
- Changes to this policy will be communicated to subscribers via email at least 30 days before taking effect.
- Continued use of the platform after the notice period signifies acceptance of the updated policy.
